These Terms of Use (“Terms”) govern your use of Tracklow at tracklow.com (the “Site”), which is owned and operated by Track Low, LLC (“Tracklow,” “we,” “us”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. What Tracklow provides

Tracklow shows historical price information for certain products sold by third-party retailers, such as Amazon, along with summary figures (for example, the lowest price in the last 90 days) and general guidance on whether a price is near its recent lows. The Site is provided for your personal, non-commercial use.

2. No scraping, crawling or automated collection

You may not, and may not permit or help anyone else to:

  • use any robot, spider, scraper, crawler, script, browser automation or other automated means to access, collect, copy, index or monitor any part of the Site or its content, including price information, charts and the data that loads them;
  • access the Site through any interface other than a standard web browser used by a person, or retrieve the Site's data programmatically;
  • circumvent, disable or interfere with any rate limit, access control or security feature of the Site, or make requests at a volume that burdens the Site; or
  • use the Site or its content to build, train or improve any database, dataset or machine-learning model.

General-purpose search engines may crawl the Site, in line with our robots.txt file, solely to include the Site's pages in public search results. We may block, limit or challenge any access we believe breaks this section.

3. No redistribution or resale

You may not copy, reproduce, republish, distribute, sell, resell, license, sublicense, rent or otherwise commercially exploit the Site or any of its content, including price information, price histories, charts or summary figures, whether in original or modified form, and whether alone or combined with other data. You may share links to the Site's pages.

4. Price information is provided “as is”

Price information on the Site comes from third-party sources and is updated periodically, not in real time. It may be delayed, incomplete or inaccurate, may not reflect taxes, shipping, discounts, coupons or seller-specific offers, and may differ from the price a retailer charges you. The retailer's price at the time of purchase controls. We do not guarantee the accuracy, completeness, timeliness or availability of any information on the Site. Always check the retailer's site for current price and availability before you buy.

5. Not a purchase recommendation

Price information and any guidance on the Site, including statements such as “a good time to buy” or “consider waiting,” are general information based only on past prices. They are not a recommendation to buy or not buy any product, do not predict future prices, and do not take your circumstances into account. They are not financial, legal or other professional advice. You are solely responsible for your purchasing decisions.

6. Retailers, affiliate links and third-party sites

The Site links to third-party retailers. As an Amazon Associate, Tracklow earns from qualifying purchases; see our Affiliate disclosure. We do not sell products, are not responsible for third-party sites, products, prices or policies, and are not affiliated with or endorsed by any retailer unless stated. Your purchases are solely between you and the retailer.

7. Intellectual property

The Site and its content, design and compilation are owned by Track Low, LLC or its licensors and are protected by law. Product names, brands and trademarks belong to their respective owners. Except for viewing the Site for your personal, non-commercial use as allowed by these Terms, no rights are granted to you.

8. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRACK LOW, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, SAVINGS, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO THE SITE, ITS CONTENT OR ANY PURCHASE YOU MAKE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify and hold harmless Track Low, LLC and its members, managers, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or misuse of the Site.

11. Changes and access

We may change, suspend or discontinue any part of the Site at any time, and may suspend or end your access if we believe you have broken these Terms. We may update these Terms by posting a new version on this page with a new “Last updated” date. Your continued use of the Site after that means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of Louisiana, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Jefferson Parish, Louisiana, and you consent to their jurisdiction.

13. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and us about the Site.
